PERSONAL DATA PROCESSING DISCLAIMER IN COMPLIANCE WITH ART. 13 OF ITALIAN LEGISLATIVE DECREE N. 196 DATED 30TH JUNE 2003 ("PERSONAL DATA PROTECTION CODE")

Www.stefanocau.com ("Website") is the trading name of and owned by STEFANO CAU SRL., Via Adamo Del Pero , 22100 Como. In order to allow your registration on the Website, the access to the Website's services, including the e-commerce service, and to ensure the correct fulfillment of such services, SC, in its capacity of Data Controller, will process any personal information collected from the customer in accordance with the Italian Legislative Decree n° 196 dated 30th June 2003 ("Personal Data Protection Code").

This privacy statement is intended for any individual interacting with the Website, and in particular:

  a. for those who use the Website without registering;
  b. for those who register on the Website and make use of the online services offered by the Website,      including the e-commerce services.

This privacy statement is in compliance with article 13 of the Personal Data Protection Code, and in accordance with Recommendation n. 2/2001 approved on 17th May 2001 by the European Authorities for the Protection of Personal Data, reunited as specified at art. 29 of Directive 95/46/EC, which identifies the minimum requirements for collecting personal data online.

It is possible to access the Website without being required to provide any personal data. However, the information system that runs the Website acquires in the course of its normal functioning some personal data, the transmission of which is implicit in the use of Internet communication protocols.

Art. 1. Purpose of data processing

The processing of personal data is specifically intended for the following purposes:
a. to register on the Website, and to comply with the requirements of current regulations and legislation;
b. in case of use of the e-commerce services provided by SC:
1. to promptly ensure the correct processing of the online purchase and thus comply with all the obligations resulting from the contractual relation with the customer, as well as with the requirements of current regulations and legislation;
2. to allow the sending of direct marketing communications (i. e. soft spamming) about products and related services to the email address provided at the moment of purchase on the Website, unless otherwise requested;
c. upon your explicit consent, to subscribe to mailing lists managed by the Company, undertake market researches and receive promotional and informative material from SC about the products and services offered by SC or third parties through automated systems, such as e-mail and SMS, or by telephone and post;
d. upon your explicit consent, to create your commercial profile (by analysing tastes, preferences, habits and/or consumer behaviour), in order to both monitor your level of satisfaction and ensure that all your needs are met, and to send relevant informative and/or promotional material through automated systems, such as e-mail and SMS, or by telephone and post;
e. for statistical purposes and records.


Art. 2. Personal data disclosure and consequences of data disclosure refusal

The disclosure of personal data for the purposes described at points a) and b1) of art. 1 is purely discretionary. However, it is necessary to obtain such data in order to register on the Website and, therefore, make use of the services offered by SC through the Website, including the e-commerce services; the refusal to provide the requested data will result in the inability to complete the registration procedure and to purchase from the Website.
Following your registration on the Website, if you intend to make an online purchase, you will have to enter additional information concerning the desired shipping address. Data processing is necessary in order to make a purchase on the Website and refusal to provide such data will result in the inability to complete the online purchase.
If your payment method of choice is credit card, you will be asked to enter your credit card details. Credit card information will not be processed by SC in any case, only the payment service provider will have access to them for the purpose of handling the payment.
With regard to the data processing purposes described at points c) and d) of art. 1, please note that the consent to data processing is purely discretionary. The refusal to consent to data processing will not result in any restriction in registering on and buying from the Website.
Data processing refusal will uniquely imply the following:
The refusal to consent to data processing for the purposes described at point c) of art. 1, will prevent you from receiving promotional and informative material and/or newsletters, communications from SC about SC's or third parties' products and services by email and SMS or by telephone and post, as well as not allowing SC to consider your profile for market research purposes;
The refusal to consent to data processing for the purposes described at point d) of art. 1, will prevent the Company from creating a profile based on your consumer behaviour (aimed at ensuring that all your needs are met and to support the continuous improvement of the services offered), and from sending you relevant informative and promotional material by email and SMS or by telephone and post.
The consent given to data processing for one or more of the aforementioned purposes can be revoked at any time, by editing your personal data processing preferences whenever you log into your account on the Website.
Additionally, you can revoke at any time the consent to processing your personal data concerning the purposes described at the points b2) (i. e. soft spamming) and c) of art. 1 by clicking on the [Unsubscribe] link at the bottom of any promotional or informative communication that you will receive.

 

Art. 3. Data processing methods

Your personal data will be processed mainly through electronic or automated means, using suitable procedures to guarantee security and confidentiality in compliance with the Personal Data Protection Code. In particular, we maintain all the appropriate physical, technical, and administrative measures to protect your personal information and ensure the minimum level of data protection established by the law. The collected data can be accessed only by authorised individuals or authorised data processors designated by the Data Controller. 

The collected data is maintained and processed until the fulfillment of the contractual obligations connected with the purchase of goods and services from the Website.
Data will be stored and protected in environments with restricted access.


Art. 4. Communication and dissemination of data

The personal data collected, for the purposes described at points a) and b) of art. 1, will be shared with SC employees or partners which will process them in their capacity as data processors or designated individuals in charge of the processing.
Your data may also be shared with:
a. all those entities (including Public Authorities) which hold the right to access personal data as established by legislative or administrative provisions;
b. companies or third parties in charge of printing, packaging, shipping and/or delivery of the products purchased on the Website;
  c. post offices, couriers or freight forwarders in charge of the delivery of the products purchased on the Website;
d. companies, consultants or professionals in charge of the installation, the maintenance, the upgrading and, in general, the management of the hardware and software owned or used by the Company for the provision of its services;
e. companies or Internet providers in charge of sending documentation and/or informative material;
f. companies in charge of processing and/or sending promotional and informative material on behalf of SC;
g. all those public and/or private entities, natural and/or legal persons (law, administrative and accountancy firms, Judicial Offices, Chambers of Commerce, Trade Union Offices, etc.), whenever the disclosure is necessary or needed to the fulfillment of the contractual obligations as well as the legal ones.

Your personal data will be used in an anonymous and aggregated form for statistical or research purposes only.

Art. 6. Storage of personal data

Your personal data will be retained only for the time needed in order to guarantee the fulfillment of the services offered by SC.
In case your account on the Website is deleted, excluded or disabled after a period of inactivity, your data will be retained for administrative purposes for a period of no longer than 90 days, unless otherwise established by any legal obligation on the retention of accounting records or for public security purposes. In such cases, data will be automatically deleted by third parties as well.
In any case, your personal data will be retained and processed for consumer behavior studies and marketing purposes for the period of time permitted by law and in accordance with the Data Protection Authority regulations.
After this period, your data will be rendered anonymous and retained in a form in which identification of the data subject is no longer possible.

Art. 7. Right to access personal data
In compliance with art. 7 of the Personal Data Protection Code, you are entitled to:

 a. obtain confirmation of the existence of personal data pertaining to you and obtain them in an comprehensible form;
 b. obtain from the Data Controller:
information about the source of the personal data, the purpose they are being used for, the way they are being used, the logic behind their possible electronic handling;
information on the identification details of the Data Controller;
information about the entities or the categories of entities whom the data may be shared with or who may access them in their capacity as country representative, data processors or designated individuals in charge of the processing;
 c. obtain:
the updating, rectification or integration of your data;
the deleting, anonymisation or blocking of data processed in violation of the law, including those whose retention is necessary in order to fulfil the purposes for which the data were originally collected or subsequently processed;
confirmation that the operations referred to in the above points have reported to all those the data were shared with or disseminated to, also in terms of content, except if such operation is not impossible or requires the use of excessive means in comparison to the protected right;
 d. object, whether in whole or in part:
for legitimate reasons, to the processing of your personal data, even if they are pertinent to the purpose of the collection;
to the processing of your personal data for the purpose of sales information, the sending of promotional or direct marketing material, market research or commercial communication. Please note that refusal to consent to personal data processing for the purposes described at points b2) and c) of art. 1 through automated systems (e-mail and SMS) is extended to traditional means of contact (post and telephone), except if the customer specifically choses to exercise his right in part, i. e. to reject communications originating only from selected means of contact, for example automated systems.
